The services provided through Adaptive Coaching are professional life coaching and personal development coaching services. These services are designed to help individuals and couples improve their emotional well-being, relationships, and personal development.

Important Distinction: These services are NOT licensed psychotherapy, psychiatric treatment, or medical care. Michael Etts operates as a professional coach, not as a licensed mental health professional in any US jurisdiction. Coaching focuses on personal growth, goal achievement, and life improvement rather than diagnosis or treatment of mental health disorders.

International Practice Disclosure

Adaptive Coaching operates from the Republic of Panama and is not licensed or regulated by any US state licensing board or regulatory body. Services are provided internationally via telehealth (Google Meet). By engaging our services, you acknowledge that you understand this international practice arrangement.

Not a Substitute for Medical Care

While we are committed to providing high-quality professional services, we cannot guarantee specific outcomes or results from our coaching or counseling services. Individual results may vary based on many factors including individual commitment, circumstances, and other variables.

Scope of Practice

Our services are provided within the scope of professional coaching and counseling practice. We do not provide medical diagnoses, prescribe medications, or treat severe mental health disorders that require specialized medical intervention.

Telehealth Limitations

Our services are provided via telehealth (Google Meet). While we take reasonable precautions to ensure privacy and security, there are inherent limitations and risks associated with electronic communication that clients should be aware of and accept.

Limitation of Liability

To the maximum extent permitted by applicable law, Adaptive Coaching and Michael Etts shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or other intangible losses, resulting from your access to or use of (or inability to access or use) our services.

In no event shall Adaptive Coaching's total liability for any and all claims arising from or related to services provided exceed the total amount paid by you for the specific session(s) giving rise to the claim during the six (6) months preceding the claim.

Client Responsibilities

• Provide accurate and complete information during sessions
• Attend scheduled sessions or provide appropriate notice for cancellations
• Maintain appropriate boundaries and respect during sessions
• Take responsibility for implementing strategies and insights gained through coaching
• Seek emergency medical care when appropriate, rather than relying solely on coaching services

Assumption of Risk and Informed Consent

By engaging the services of Adaptive Coaching, you acknowledge and agree to the following:

• Personal development and coaching involve exploring personal matters that may surface difficult emotions, memories, or realizations
• You voluntarily assume any risks associated with the coaching process, including emotional discomfort that may arise during or after sessions
• You are voluntarily participating in coaching services and take full responsibility for your own choices, actions, and results
• The coach is not liable for any emotional distress, life changes, or consequences that may occur as a result of the coaching process
• You have the right to terminate coaching services at any time

By scheduling and attending sessions, you confirm that you have read and understood this assumption of risk and voluntarily consent to participate in coaching services under these terms.

Confidentiality

We maintain strict confidentiality regarding all client information, within the bounds of applicable laws and ethical guidelines. Information shared during sessions will not be disclosed without written consent, except in cases where:

• There is imminent risk of harm to self or others
• There is suspected abuse of a minor or vulnerable adult
• Disclosure is required by law or court order

Payment and Cancellation Policy

Payment is required at the time of service. Our current rate is $150 per 50-minute session. Cancellations must be made at least 24 hours in advance, or a $75 fee may apply.

Governing Law and Jurisdiction

These Terms of Use, the provision of services, and any disputes arising from or related to services provided by Adaptive Coaching shall be governed by and construed in accordance with the laws of the Republic of Panama, without regard to its conflict of law provisions.

You agree that any legal action or proceeding arising out of or related to these terms or services provided shall be brought exclusively in the courts located in Panama City, Republic of Panama. By using our services, you irrevocably consent to the personal jurisdiction and venue of such courts and waive any objection based on inconvenient forum.

Dispute Resolution and Arbitration

Before initiating any legal proceeding, you agree to first attempt to resolve any dispute informally by contacting us directly. If the dispute cannot be resolved informally within thirty (30) days, you agree that any dispute, claim, or controversy arising out of or relating to these terms or the services provided shall be resolved by binding arbitration administered in Panama City, Panama.

Class Action Waiver: You agree that any arbitration or legal proceeding shall be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Adaptive Coaching.

Modifications

Adaptive Coaching may revise these terms of use and disclaimer at any time without notice. By using this website, you are agreeing to be bound by the current version of these terms and conditions.
